§ 25-2. Skateboards on sidewalks in downtown C-3 district.

  • (a)

    Unless the context clearly indicates otherwise, the words, combinations of words, terms and phrases, as used in section 25-2, shall have the following meanings set forth in the subdivisions of this section which follow:

    (1)

    "Person" includes an individual, partnership, corporation, the state and its agencies and subdivision, and any body of persons, whether incorporated or not.

    (2)

    "Skateboard" means a device for riding upon, usually while standing, consisting of an oblong piece of wood or of other composition mounted on skate wheels.

    (3)

    "Roller skate" means a form of skate with small wheels or rollers instead of a runner.

    (4)

    "Operate" means to ride on or upon or control the operation of a skateboard or roller skates.

    (5)

    "Operator" means every person who operates a skateboard or roller skates.

    (b)

    Regulation of the use of roller skates or skateboards. It shall be unlawful for any person to operate a skateboard or roller skates under the circumstances set forth in the subparagraphs which follow:

    (1)

    On private property of another without the express permission to do so by the owner or occupant of said property.

    (2)

    In any careless, reckless or negligent manner so as to endanger, or be likely to endanger the safety of any person or property of any other person.

    (3)

    Upon any public street or upon any public sidewalk within the zoned downtown C-3 district in the city.

    (4)

    The operator of a skateboard or roller skates emerging from an alley, driveway or building upon approaching a sidewalk or the sidewalk area extending across any alleyway shall yield the right-of-way to all pedestrians approaching the sidewalk or sidewalk area and upon entering the roadway shall yield the right-of-way to all vehicles approaching on the roadway.

    (5)

    No person operating a skateboard or roller skates shall be towed by any motor vehicle upon a public street or parking lot.

    (6)

    Every person operating a skateboard or roller skating upon a roadway shall ride as close as possible to the curb or edge of the roadway.

    (7)

    No person shall roller skate or use a skateboard upon a public street, sidewalk or other roadway after sunset and before sunrise.

    (8)

    No person shall roller skate or use skateboards upon a state highway in the city.

    (c)

    Impoundment of skateboards and roller skates. A person apprehended by a police officer in violation of the provisions of this section does by their use of the public streets and sidewalks consent to the impoundment by a police officer of the skateboard or roller skates for a period of three (3) days upon an offense. Any operator aggrieved by the impoundment of their skateboard or roller skates may petition the council for hearing hereon at the next regular council meeting following the impoundment. This provision is in addition to the provisions for fines and penalties that may be established by the city council.
