§ 25-28. Erecting, maintaining, removing awnings projecting over public streets or sidewalks; violations.

  • (a)

    No person shall erect or maintain any awning in front of, or adjoining or attached to any building on the line of a street in the city which extends over or across such a street without first having obtained permission therefor from the building official.

    (b)

    Every awning erected subsequent to receiving permission, as required in subsection (a) of this section, shall be at least, when in position, seven (7) feet from and above the sidewalk or street over which it extends.

    (c)

    Any person erecting or maintaining any awning contrary to this section shall be guilty of a misdemeanor, and upon order of the council, it shall be the duty of the city administrator to remove any such awning, at the expense of the person so erecting or maintaining the same, to be recovered in a civil action.
