§ 26-1. Planting shade and ornamental trees in street rights-of-way.

  • (a)

    When planting shade and ornamental trees within the rights-of-way of the streets of the city, such trees shall be set a distance of ten (10) feet from the paved portion of the street in which they are placed.

    (b)

    It shall be the duty of the owner (if a resident within the city) or occupant of any lot or ground, adjacent to which any tree may be planted contrary to the provisions of this section, to remove such tree upon not less than five (5) days' written notice.

    (c)

    This section shall not apply to a tree set to replace another which has died and which was one of a row already planted.
