§ 28-190. Reimbursement to persons paying for oversized service.

  • Whenever any person (as defined in section 28-96) owning land contiguous to the city limits shall petition for water and sanitary sewer, and the council shall determine that in accordance with proper planning procedures that such services should be oversized to serve future annexed territories and that as a condition of granting the petition the petitioner agrees to pay for such oversized improvements, the city shall reimburse such petitioner any amounts assessed pursuant to section 28-189 if such annexation shall occur within a period of fifteen (15) years from the time that the petitioned improvement is completed and accepted by the city.
