§ 4-24. Revocation or suspension of a license or permit.

  • (a)

    Grounds. The city council shall suspend for a period not to exceed sixty (60) days or revoke any liquor license upon finding that the licensee has failed to comply with any applicable statute, regulation or provision of this chapter relating to liquor.

    (b)

    Due process. Except in the case of lapse of proof of financial responsibility, no suspension or revocation shall take effect until the license or permit holder has been given an opportunity for a hearing.

    (c)

    Minimum period of suspension or when revocation is warranted. The following are the minimum periods of suspension or when revocation is warranted which shall be imposed by the city council for violations of this chapter or Minnesota Statutes Chapter 340A or any rules promulgated under that chapter.

    (1)

    For commission of a felony related to the licensed activity, sale of alcoholic beverages while the license is under suspension, sale of intoxicating liquor where the only license is for 3.2 percent malt liquor, or failing to disclose information or making false statements on the application, the license shall be revoked.

    (2)

    The license shall be suspended by the city council after a finding that the holder has failed to comply with any applicable statute, rule, or provision of this chapter for at least the minimum periods as follows:

    a.

    For the first violation within any three-year period, at least a one-day suspension in addition to any criminal or civil penalties which may be imposed;

    b.

    For the second violation within any three-year period, at least a three consecutive days suspension in addition to any criminal or civil penalties which may be imposed;

    c.

    For the third violation within any three-year period, at least a seven consecutive days suspension in addition to any criminal or civil penalties which may be imposed;

    d.

    For a fourth violation within any three-year period, the license shall be revoked.

    (d)

    Effect on Sunday sale licenses. Upon suspension or revocation of an on-sale liquor license, the suspension will include the automatic revocation or suspension of the Sunday sale license which is held by the suspended or revoked on sale license holder. Further, the city council may, at its discretion, suspend or revoke both the on-sale and Sunday sale licenses, upon any violation or conviction under the Sunday sale license, or may suspend or revoke the Sunday sale license only.
