§ 6. [Liability.]

By construction of said skyway the Faribault Canning Company, Inc. assumes all of the terms and conditions of such franchise as hereinbefore set forth and further agrees, consents, and assents that it shall be personally liable for all damages, lawful claims and demands for injury to person or property arising out of the use and maintenance of such skyway and agrees to hold harmless and indemnify the city for any claim which shall ever be made as a result of the construction and maintenance of such skyway and shall defend the city against any action or suit filed against it arising out of the construction, use or maintenance of said skyway or out of the enactment of this franchise. The company shall carry a public liability policy naming the city as an additional party insured against all damages arising out of the use of maintenance of said skyway in the amount of five hundred thousand dollars ($500,000.00). A copy of such policy shall be filed with the city and maintained during the entire franchise period.
