§ 22-2. Excavating beneath tracks.

  • (a)

    The right of the city to enter and excavate beneath any portion of railroad tracks in the city for the purpose of constructing, laying, repairing or extending under the surface, water mains, sewers and such other works of public improvement as, from time to time, shall become necessary or be deemed advisable by the council is hereby reserved.

    (b)

    Such improvements described in subsection (a) of this section shall be made in such manner as to occasion the least possible inconvenience to the company.

    (c)

    The company, after notice from the city engineer of the city's intention to do any such work described in subsection (a) of this section, shall properly support and protect its track and, when necessary, shall remove and replace the same without any cost to the city.
