§ 25-58. Width.

  • (a)

    The standard width of all sidewalks in the city shall be six (6) feet; except that:

    (1)

    Walks on streets less than sixty (60) feet in width shall be five (5) feet wide.

    (2)

    Walks in front of parks and public buildings of importance may be of special width by resolution.

    (3)

    Walks on business streets in which the boulevard has been eliminated by resolution shall extend from the property line to the curb.

    (b)

    In all cases in the city where the boulevard has not been eliminated, the sidewalks shall be located with the side nearest the property line one foot therefrom as nearly as can be determined; provided that, when any existing tree is larger than four (4) inches in diameter above the ground swell that obstructs such location, in order to preserve such tree, it may be allowable to indent the sidewalk adjacent to such tree or to offset the sidewalk not exceeding one-half (½) its width, but only toward the property line, and such walk shall be jointed longitudinally one foot from the property line. After the destruction or removal of the tree, the portion of the walk beyond its normal line shall be removed and the full width of the walk constructed to its correct location, with the cost thereof assessed to the abutting property. It is further provided that, when by reason of a steep hill or gully the sidewalk cannot be built according to the standard location herein specified, it may be allowable to use any other practical location which does not conflict with the provisions of section 26-1 of this Code relating to shade and ornamental trees.
